1. Acceptance of Terms

By installing, accessing, or using the Rating Scale Connect Google Workspace Add-on (the “Service”), provided by Smarter School Psych, LLC (“we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.

2. Description of Service

Rating Scale Connect is a productivity tool designed to assist school psychologists and educational professionals in tracking, managing, and emailing links to digital rating scales via Google Sheets™ and Gmail™.

The Service functions as an interface to help you manage your own data within your own Google Workspace environment. We do not store your data on external servers; your data resides within your Google account.

3. User Responsibilities & Data Compliance (FERPA/HIPAA)

You acknowledge that the Service is used to process sensitive educational and potentially medical records (“Protected Information”). By using the Service, you agree that:

  1. Data Ownership: You retain sole ownership and control of all data entered into the Service.
  2. Compliance: You are solely responsible for ensuring that your use of the Service complies with all applicable laws and regulations, including but not limited to:
    • The Family Educational Rights and Privacy Act (FERPA).
    • The Health Insurance Portability and Accountability Act (HIPAA), if applicable.
    • The Individuals with Disabilities Education Act (IDEA).
    • General Data Protection Regulation (GDPR), if applicable.
  3. Consent: You represent and warrant that you have obtained all necessary consents and authorizations to input Student and Respondent data into the Service and to contact Respondents via email.

4. Account Security

You are responsible for maintaining the confidentiality of your Google account credentials. You are fully responsible for all activities that occur under your account while using the Service. You agree to notify us immediately of any unauthorized use of the Service.

5. Third-Party Services

The Service operates within the Google Workspace™ environment and may facilitate links to third-party assessment platforms (e.g., Pearson Q-Global™, MHS Online Assessment Center™, etc.).

  1. Google Workspace: This Service depends on the continued availability of the Google Apps Script API. We are not liable for interruptions caused by Google’s removal or modification of these APIs.
  2. Assessment Publishers: We are not affiliated with, endorsed by, or connected to any test publishers (e.g., Pearson, MHS, WPS). You are responsible for adhering to the Terms of Service of any third-party platform you link to via our Service.

6. Intellectual Property

The Service, including its original source code, design, and functionality, is the exclusive property of Smarter School Psych. The “Rating Scale Connect” name and logo are trademarks of Smarter School Psych. You are granted a limited, non-exclusive, non-transferable license to use the Service for your professional or personal use. You may not reverse engineer, decompile, or attempt to extract the source code of the Service.

7. Fees and Payment (If Applicable)

The Service is currently provided free of charge. We reserve the right to introduce fees for future features or versions with prior notice.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

TO THE FULLEST EXTENT PERMITTED BY LAW, WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  1. IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
  2. WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.
  3. WARRANTIES THAT THE EMAILS SENT VIA THE SERVICE WILL BE DELIVERED OR NOT MARKED AS SPAM BY RECIPIENTS.

YOU ASSUME ALL RISK FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE USE OF THE SERVICE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SMARTER SCHOOL PSYCH, ITS AFFILIATES, AGENTS, OR EMPLOYEES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  1. YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE;
  2. ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE;
  3. ANY UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS ($100) OR THE AMOUNT YOU PAID US, IF ANY, IN THE PAST TWELVE MONTHS FOR THE SERVICE.

10. Indemnification

You agree to defend, indemnify, and hold harmless Smarter School Psych from and against any claims, damages, costs, liabilities, and expenses (including attorney’s fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; or (c) your violation of any third-party rights, including FERPA/HIPAA privacy rights.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting the new Terms on our website or within the Add-on. Your continued use of the Service after any such change constitutes your acceptance of the new Terms.

12. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

13. Governing Law

These Terms shall be governed and construed in accordance with the laws of [Your State/Country], without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
